Nikon School Terms & Conditions

Definitions

In these Terms and Conditions:

Event means the event detailed in the Schedule.
Event Organisers means Nikon Australia Pty Ltd, and any Other Organiser.
Other Organiser means any party set out in the Schedule.
Participant means the person set out in the Schedule.
 
Safety

You understand that participation in the Event may involve the use or handling of dangerous equipment, walking on slippery surfaces and walking around roads. You further understand that participating in the Event is extremely dangerous and potentially hazardous and accept all risks involved in the Event and your and the Participant’s participation in it, whether or not described in these Terms and Conditions.

You agree, and you shall ensure that the Participant agrees, to abide by all lawful directions given to you and the Participant by the Event Organiser’s personnel while you are participating in the Event. You agree to take care for your own safety, and to wear safe, appropriate clothing while participating in the Event.

 
Personal Responsibility for Property

You are responsible for your safe keeping and the security of all and personal property that you bring to the Event and understand that the Event Organisers do not accept any responsibility whatsoever for any loss, damage or harm caused to your personal property and chattels.

 
Waive, Release, Discharge and Indemnity

You release, waive and discharge the Event Organisers, and its officers, directors, agents, representatives, employees, successors, assigns, and licensees (together, the Released Parties) from any and all claims, actions, liabilities, losses, costs and expenses of any kind, including without limitation, legal costs on demand, whether caused by negligence or otherwise, arising out of your, or the Participant’s, participation in the Event, to the maximum extent permitted by law.

You agree to indemnify the Released Parties and keep the Released Parties indemnified from any and all liabilities, claims or causes of action that may be brought against the Released Parties as a result of, or in connection with your, or the Participant’s, participation in the Event, to the maximum extent permitted by law.

 
Warranties and Undertakings

You warrant that:

a. you have read and understand these Terms and Conditions and explained them to your child or children;
b. you are the parent or guardian of the Participant and have the authority to agree to these Terms and Conditions on behalf of the Participant; and
c. you have explained the terms set out in these Terms and Conditions to the Participant.
 
Photography of the Participant, including Minors

By agreeing to these Terms and Conditions and participating in the Event, you consent to:

a. the taking of images and/or footage of you or the Participant, by still camera or video camera and the use of such images or footage by the Event Organisers and its authorised agents in all media and formats without any further approval or compensation;
b. the reproduction by Nikon Group, or printing of the Event Organisers’ image(s) by way of film or photograph, and the Participant captured during the course of the Event; and
c. the use (and Nikon’s right to use the Participant’s name) for use in printed or electronic brochures or magazines, the Nikon Group’s or Nikon School’s social media accounts, including Instagram, and Nikon School’s website (provided no persons under 18 will be directly identified by their full name); and
d. Nikon School and its representatives to use any pictures, portraits, photographs or video taken or to be taken in connection with any Event for any purpose whatsoever, in any form, without restriction in relation to territory or media. Nikon shall have the right to assign or license the above rights to others, including without limitation any image(s) or recordings the copyright of which will remain with Nikon but may be assigned or licensed in connection therewith.
 
Privacy & Entire Agreement

The Event Organisers collect your personal information so that you and the Participant can enter the Event. This can gain access to, or seek correction of, your registration information and the personal information of the Participant, or request to have it deleted. If the Event Organisers from time to time update their Privacy Policy, you can request an up-to-date version during the administration or facilitation of the Event. The Event Organisers will not disclose your or the Participant’s personal information to any third party except as specified in these Terms and Conditions, except where we may require written consent.

 
Entire Agreement

These Terms and Conditions are the entire agreement between you and the Event Organisers relating to the Event and supersedes any prior agreements or arrangements (whether oral or in writing) between you and the Event Organisers relating thereto. This agreement can only be modified in written instrument signed by you and the Event Organisers.
